Welcome to Gentei Store. These Terms of Service ("Terms") apply to your use of the website gentei.store (the "Site") and to every order placed through it. The Site is operated by Gentei Store, Baba Sali 10, Dimona, Israel ("Gentei", "we", "us", "our"). By browsing the Site or placing an order you agree to these Terms. If you do not agree to them, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your place of residence, to place an order. By using the Site you confirm that you meet this requirement, or that you are using the Site under the supervision of a parent or legal guardian who accepts these Terms on your behalf.
2. Products and Authenticity
Gentei sells officially licensed collectibles and merchandise produced by authorized manufacturers. All character names, series titles, artwork, logos, and related marks appearing on the products are trademarks and copyrights of their respective owners. Such names are used on the Site only to identify and describe the merchandise offered for sale. Gentei Store is an independent retailer and is not sponsored or endorsed by, or affiliated with, any of these rights holders.
Product photos are for illustration. Actual items may show minor variations in color, finish, or packaging, and your screen settings can affect how colors appear.
3. Limited Editions and Availability
Many of our products are region exclusives or limited editions produced in fixed quantities. These items are sold on a first come, first served basis and may sell out without notice. We may set a per customer purchase limit on selected items and may cancel orders that we reasonably believe were placed to bypass such limits, including orders placed through multiple accounts or addresses.
4. Orders and Acceptance
Your order is an offer to purchase. The order confirmation email acknowledges that we received your order and does not by itself constitute acceptance. A contract is formed when we ship the products to you. We may refuse or cancel any order before shipment, for example in cases of suspected fraud, stock unavailability, or errors in product or pricing information. If we cancel an order after payment, we will issue a full refund to the original payment method.
5. Prices and Payment
Prices are shown in the currency indicated at checkout and may change at any time, although changes will not affect orders that have already been accepted. Prices do not include import duties or taxes charged in the destination country (see Section 6). Payment is processed through Shopify's secure checkout using the payment methods offered there. If a product is listed at a clearly incorrect price due to a typographical or technical error, we may cancel the order and refund any amount paid.
6. Shipping, Duties, and Risk
We ship worldwide from Israel. Shipping methods, costs, and estimated delivery times are described in our Shipping Policy and shown at checkout. International orders may be subject to import duties, customs fees, and taxes charged by the destination country. These charges are the recipient's responsibility and are not collected by us. Risk in the products passes to you upon delivery.
7. Returns and Refunds
Returns, refunds, and replacements are handled as described in our Return and Refund Policy. Nothing in these Terms limits any statutory rights you have as a consumer under the laws of your country of residence.
8. Order Cancellations
To cancel an order, contact us at service@gentei.store as soon as possible. Orders can be cancelled free of charge as long as they have not shipped. Once an order has shipped it can no longer be cancelled, but it may be returned under our Return and Refund Policy.
9. Intellectual Property
The Site and its original content, including text, graphics, page layouts, and the Gentei name and logo, are owned by Gentei Store or its licensors and are protected by applicable intellectual property laws. Third party trademarks appearing on products or in product descriptions remain the property of their respective owners. No license or right to use any trademark or content is granted to you through your use of the Site or the purchase of any product.
10. Acceptable Use
You agree not to use the Site for any unlawful purpose, to provide false or misleading information, to interfere with the operation or security of the Site, to collect data from the Site by automated means, or to attempt unauthorized access to any part of the Site or its systems. We may suspend or terminate access in case of a violation of this section.
11. Reviews and Submissions
If you submit reviews, comments, or other content to the Site, you grant us a non-exclusive, royalty free, worldwide license to use, reproduce, and display that content in connection with the Site and our marketing. You are responsible for the content you submit, and it must not be unlawful, misleading, or infringing on the rights of others. We may remove or edit submitted content at our discretion.
12. Third Party Links
The Site may contain links to third party websites or services that we do not control. We are not responsible for their content, policies, or practices, and a link does not imply endorsement. Your use of third party sites is at your own risk and subject to their terms.
13. Disclaimer
The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties regarding the operation of the Site, including that it will be uninterrupted or error free. This section does not affect product warranties or consumer guarantees that apply to purchased goods under applicable law.
14. Limitation of Liability
To the fullest extent permitted by law, Gentei Store will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or the purchase of products, and our total liability for any claim will not exceed the amount you paid for the order giving rise to that claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under mandatory consumer protection provisions in your country of residence.
15. Indemnification
You agree to indemnify and hold Gentei Store harmless from claims, damages, and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Israel, and the competent courts in Israel will have jurisdiction over disputes arising from them. If you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction whose laws grant you mandatory consumer protections or the right to bring proceedings before your local courts, nothing in this section deprives you of those protections or rights.
17. General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies referenced in them, form the entire agreement between you and Gentei Store regarding the Site.
18. Changes to These Terms
We may update these Terms from time to time. The version published on the Site when you place an order is the version that applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
